Cold Lake First Nations Seeks Federal Court Review of Pacific Link Pipeline Designation

Cold Lake First Nations has filed an application for judicial review challenging the Canadian federal government’s decision to designate the Pacific Link oil pipeline as a project of national interest. The designation could accelerate development of the proposed West Coast project, which Canada and Alberta are advancing together.

The proposed pipeline would carry up to 1 million barrels of crude oil per day to British Columbia’s coast, supporting plans to expand exports to Asian markets and reduce Canada’s reliance on the United States. Canada and Alberta are set to share equal ownership of Pacific Link, while Indigenous communities would be offered at least a 10% ownership stake backed by federal and provincial loan-guarantee programs.

Trans Mountain Corporation is leading development, with Pembina Pipeline Corporation providing project expertise. The planned southern route is intended to avoid British Columbia’s North Coast and sensitive areas including the Great Bear Sea.

Cold Lake First Nations said it is seeking to protect its Treaty rights, lands and the interests of future generations. The Nation said it had asked Canada to consult on Pacific Link and the Pathways project and proposed options for engagement, but that the designation proceeded without meaningful consultation. It said it remains open to working collaboratively, while responsibility for taking the first step outside court now rests with Canada.
