Community banks challenge OCC's crypto charter approval

A group of community banks has filed a lawsuit against the Office of the Comptroller of the Currency (OCC), arguing that the agency has exceeded its congressional authority by allowing cryptocurrency companies to obtain national trust bank charters. The Independent Community Bankers of America (ICBA) filed the suit in federal court, claiming the OCC's decision to grant these charters to crypto firms lacks necessary safeguards and fails to meet standard banking requirements. ICBA president and CEO Rebeca Romero Rainey stated that Congress did not intend for the national trust charter to serve as a pathway for crypto firms to gain federal credibility without adhering to regulations like the Community Reinvestment Act, consolidated supervision, capital standards, and FDIC insurance. The OCC has not yet commented on the lawsuit. Cointelegraph reported in August that under President Trump, the OCC had approved several crypto company applications for trust charters. Trust bank charters do not permit companies to accept deposits or make loans, distinguishing them from traditional banks.

The ICBA is seeking a court order to restore the OCC to its statutory limits. The lawsuit highlights a growing debate over the regulatory framework for cryptocurrency firms seeking federal recognition.
